1. Acceptance of Terms

By accessing or using the services provided by Dunco Web Solutions ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

2. Services

We provide web design, web development, Laravel system development, business automation, website maintenance, hosting, and related digital services. The specific scope, deliverables, timeline, and pricing for each project are defined in a separate proposal or agreement.

3. Proposals and Agreements

A proposal or quote does not constitute a binding agreement until signed or confirmed in writing by both parties.
Any changes to the project scope, timeline, or deliverables must be agreed upon in writing and may result in additional charges.

4. Pricing and Payment

All prices are quoted in Kenyan Shillings (KES) unless otherwise stated.
Payment terms are specified in each project proposal (typically: deposit before work begins, milestone payments, and final payment on completion).
Payments can be made via M-Pesa or credit/debit card through our secure payment portal.
Late payments may attract a service charge of 2% per month on the outstanding balance.
Recurring services (hosting, maintenance, support) are billed monthly or annually as agreed.

5. Project Delivery

Timelines begin once the initial payment and all required materials (content, images, access credentials) are received from the client.
Delays in client-provided materials may extend the project timeline proportionally.
We will provide regular progress updates and require client feedback at key milestones.

6. Client Responsibilities

Clients are responsible for:

Providing accurate and timely information, content, and materials
Reviewing deliverables and providing feedback within agreed timeframes
Maintaining confidentiality of login credentials and admin access
Ensuring that content provided does not infringe on third-party intellectual property rights

7. Intellectual Property

Upon full payment, the client receives ownership of the website design and custom code developed specifically for their project.
We retain the right to showcase the project in our portfolio unless otherwise agreed in writing.
Third-party tools, frameworks, and libraries used in development remain subject to their original licenses.

8. Warranties and Support

We warrant that services will be performed in a professional and workmanlike manner.
Post-launch support and maintenance are provided under a separate agreement.
We do not guarantee specific search engine rankings, traffic levels, or business outcomes.

9. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim arising from our services shall not exceed the total amount paid by the client for the specific project giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.

10. Termination

Either party may terminate a project agreement with 14 days' written notice.
Upon termination, the client is responsible for payment for all work completed up to the termination date.
We reserve the right to suspend or terminate services for non-payment.

11. Confidentiality

Both parties agree to keep confidential any proprietary information shared during the course of the business relationship.

12. Governing Law

These Terms of Service are governed by the laws of the Republic of Kenya. Any disputes shall be resolved in the courts of Kenya.

13. Changes to Terms

We may update these Terms of Service from time to time. Continued use of our services after changes constitutes acceptance of the revised terms.
